What do I have to do to Incorporate our new club.

Guidance o要 becoming incorporated in NSW can be found o要 the Department of Fair Trading web site at: http://www.fairtrading.nsw.gov.au/associations.html .

Although in NSW there is no requirement for clubs and associations to hold public liability insurance, this is a requirement for affiliation with Four Wheel Drive NSW & ACT.

What has to be in our rules or constitution

The NSW Department of Fair Trading provides a set of Model Rules that may be used as a basis for your club's constitition or rules of management. A MS Word version can be downloaded at: http://www.fairtrading.nsw.gov.au/documents/associations/mrules0402.doc

Also consider other clubs rules for guidance, but make sure you adjust them to suit your needs. Examples can be found at the following links:

Remember that your rules of management are not easy to change. Changes require a special general meeting, and then in NSW, must be submitted to the Department of Fair Trading to retain incorporation. So it is best to avoid prescribing things that might change regularly. Also avoid detailing those things that the committee should be able to change, but provide guidance o要 what authority the committee does have and under what circumstances issues should be put to a general meeting.

How do we develop our constitution or rules of management

Easiest way is covered by o要e of the follwoing three options:

  • Option 1. Use the Model Rules from the Department of Fair Trading web site and rename them to "Rules of Management" of your club
  • Option 2. Edit the Model Rules from the Department of Fair Trading web site and adjust them to reflect the specifics of your club.
  • Option 3. Adapt the constitution of another similar club and edit it to suit your organisation (don't forget to get the other club's permission first and avoid breach of copyright).

Of course, you can always develop your own constitution from scratch, but it makes sense to reuse the good work of others, where that is allowed.

The rules you adopt must be approved by a general meeting of your club, as required by the Department of Fair Trading for your incorporation.

What is the difference between a constutution and rules or management.

For all practical purposes, none whatsoever.  These are just two titles for the same thing.  Your club needs to decide what they call them, and then be consistent.

How do I affiliate my club

Download the new members kit, unzip the documents in it and:

  1. Complete the New Club Application Form
  2. Complete the Club-info-form (this is for contact details of your committee members whose details we keep privacy, and the top section is for club contact information to be published in the Clubs List at http://4wdNSW.org
  3. Copy your constitution (We are happy to review your constitution for you to help you tune it)
  4. Copy your Public Liabity insurance certificate of currency, and
  5. Copy your certificate of incorporation.

Bundle them all up and post them to us.
